New Attorneys' Minimum Fee Tariff Published in the Official Gazette: How Is the Attorney's Fee Determined?

The Attorneys' Minimum Fee Tariff, prepared by the Union of Turkish Bar Associations, was published as a communiqué in Official Gazette No. 33419 of 3 November 2026. Under its entry-into-force article (Art. 24), it entered into force on the date of publication. This article summarises the general framework from the official text. It is general information, not legal advice. The tariff's amounts are in the annex of the official text and are reproduced in tables in section 6 of this article; consult the official text for the current amounts.

1. What is the tariff for?

  • In courts, in all legal assistance, in authority decisions ending a dispute and in determining the attorney's fee imposed on the opposing party by law, Attorneys' Law No. 1136 and this Tariff apply (Art. 1/1).
  • If no contractual fee has been agreed or the agreed fee is invalid, a court cannot award a fee below the amount calculated under the tariff (Art. 1/2).
  • A fee below the minimum tariff cannot be agreed (Art. 1/3).

2. Which tariff applies?

In determining the fee, the Tariff in force on the date the legal assistance is completed or judgment is given applies (Art. 21). After a decision of reversal or setting aside, too, the Tariff in force on the date of the judgment applies (Art. 2/3). Files decided after the new tariff took effect will therefore be assessed under it.

3. Limit on the fee imposed on the opposing party

The fee imposed by courts on the opposing party for the attorney cannot be less than the amount in the tariff and cannot exceed three times it. The attorney's labour, effort, the importance and nature of the work and the length of the case are considered (Art. 3/1).

4. Key rules

  • Case becoming moot, waiver, acceptance and settlement: if the dispute ends before the preliminary examination record is signed, half the tariff fee is awarded; after it, the full fee (Art. 6).
  • Lack of jurisdiction or competence, absence of a procedural precondition: before the preliminary examination record, half the fee in certain cases, the full fee afterward; in some referral cases, no fee is awarded (Art. 7).
  • Alimony, rent determination and eviction: calculated on one year's rent in eviction cases and on one year's difference or alimony in rent determination and alimony cases; no fee is awarded for the rejected part in alimony cases (Art. 9).
  • Non-pecuniary damages: calculated on the amount awarded; if the claim is entirely rejected, the fee under the second part, second section of the tariff applies (Art. 10).
  • Enforcement proceedings: if the debtor pays within the payment period, three quarters of the tariff fee is awarded (Art. 11/4); the same rule applies to eviction proceedings (Art. 11/5).
  • Objections to consumer arbitration committee decisions: if the decision is annulled, a fee is awarded against the consumer, but not more than the accepted or rejected amount, and not where a document that existed but was not submitted to the committee was submitted to the court (Art. 12).
  • Criminal cases: where the victim is represented by counsel and the defendant is convicted or announcement of the judgment is deferred, the fee set for the representative is imposed on the defendant (Art. 14).
  • Mediation: tariff provisions form the minimum values of contractual attorney fees; special rules apply where mediation is a precondition to litigation (Art. 16).
  • Serial cases: graduated rates apply depending on the number of files (Art. 22).
  • Bad-faith or baseless actions: a bad-faith defendant or a claimant with no right may be ordered, besides costs, to pay all or part of the fee agreed with the other side's attorney (Art. 23).

5. What it means for the public

  • The losing party is generally ordered to pay the other side's attorney's fee, calculated under the tariff.
  • If a settlement is reached, its timing (before or after the preliminary examination record) may affect the fee.
  • A fee agreement with a lawyer cannot go below the tariff.
  • An attorney's fee is set in a written contract between lawyer and client. This article is not a fee quote; our office's fees are determined separately by written contract.
